In these Terms of Service, “K-3,” “we,” “us” and “our” refer to KTJB LLC.
By accessing or using the K-3 website, you agree to these Terms of Service, our Terms of Sale, Shipping Policy, Return and Refund Policy, Privacy Policy and any other policies or notices made available on the website.
If you do not agree to these terms, you must not use the website.
1. Website use
You may use the K-3 website only for lawful purposes and in accordance with these Terms of Service.
You must not use the website in any way that violates applicable law, infringes third-party rights, interferes with website operation, compromises security, or harms K-3, its customers, its partners or any third party.
2. Age and legal capacity
By using the website or placing an order, you represent that you are at least the age of majority in your jurisdiction of residence and that you have the legal capacity to enter into a binding agreement.

We make reasonable efforts to display product information, descriptions, dimensions, colors, materials, prices, availability and images accurately.
However, product images, colors, patterns, textures, scale, finishes, materials and dimensions may vary depending on screen settings, photography, production methods, artisanal processes, natural materials and other factors.
K-3 products may include handmade, artisanal, natural, limited-edition, vintage-inspired, decorative or specially produced items. Minor variations, irregularities, natural marks, shade differences, texture differences and craftsmanship details are not defects where they are inherent to the product, material or production process.
5. Errors, inaccuracies and omissions
The website may contain typographical errors, inaccuracies or omissions relating to product descriptions, availability, pricing, promotions, shipping charges, delivery times, taxes or other information.
K-3 reserves the right to correct errors, inaccuracies or omissions, to change or update information, to refuse or cancel orders, and to modify or discontinue products at any time, to the maximum extent permitted by applicable law.
If an order is cancelled after payment because of an error, K-3 will refund the amount paid for the cancelled product in accordance with applicable law.
6. Intellectual property
The K-3 website, including its design, structure, content, text, images, photographs, videos, graphics, logos, icons, product names, product designs, trademarks, trade names, service marks, audio, software and all other materials, is protected by intellectual property laws.
The K-3 name, K三 name, related marks, logos, designs, product names, product images and brand elements are owned by KTJB LLC or its licensors.
No right, title or interest in any intellectual property is transferred to you by your use of the website or purchase of products.
You must not copy, reproduce, distribute, modify, sell, license, display, publish, transmit, exploit, scrape, reverse engineer or create derivative works from the website or any website content without prior written authorization from K-3.
Any mention of Kenzo Takada on the website is made for historical, creative, biographical or informational purposes, including in connection with his role as co-founder of K-3 and creator of certain K-3 designs. Such references must not be copied, distorted, exploited or used by any third party without authorization.
7. Prohibited uses
You must not use the website or its content:
For any unlawful, fraudulent, misleading, abusive or harmful purpose.
To violate any international, federal, state, provincial, local or other applicable law or regulation.
To infringe or violate intellectual property rights, privacy rights, publicity rights or other rights of K-3 or any third party.
To submit false, misleading, incomplete or fraudulent information.
To impersonate another person or entity.
To interfere with or circumvent website security features.
To upload, transmit or distribute viruses, malware, worms or destructive code.
To scrape, crawl, harvest, mine, copy or extract data from the website without authorization.
To spam, phish, pharm, pretext or otherwise engage in deceptive activity.
To harass, abuse, defame, intimidate or discriminate.

The K-3 website runs on Shopify and may use third-party tools, applications, payment services, analytics services, marketing services, logistics tools and other technology providers.
K-3 is not responsible for interruptions, errors, failures, delays, incompatibilities, unauthorized access, data loss or other issues caused by Shopify, third-party service providers, internet networks, payment providers, carriers or other systems outside K-3’s reasonable control.

Personal information is handled in accordance with our Privacy Policy.
By using the website, you acknowledge that your information may be processed by K-3, Shopify, payment processors, logistics providers and other service providers as described in the Privacy Policy.
11. Orders and purchases
Orders and purchases made through the website are governed by the Terms of Sale, Shipping Policy and Return and Refund Policy.
In the event of inconsistency between these Terms of Service and the Terms of Sale regarding a product purchase, the Terms of Sale will prevail for that purchase.

To the maximum extent permitted by applicable law, you agree to indemnify, defend and hold harmless K-3, KTJB LLC, its affiliates, officers, directors, employees, agents, partners, licensors, suppliers and service providers from and against any claims, liabilities, damages, losses, costs and expenses, including reasonable legal fees, arising from your breach of these Terms of Service, misuse of the website, violation of law, violation of third-party rights, fraud, misrepresentation or unauthorized conduct.
16. Sanctions, export controls and restricted use
You must not use the website or purchase products in violation of applicable sanctions, embargoes, export controls, import restrictions, anti-money laundering laws or other trade compliance laws.
K-3 may restrict, suspend, cancel or refuse access, accounts, orders or services where K-3 determines that a transaction, user, destination, payment method, carrier route, product or use may be unlawful, restricted, prohibited, high-risk or subject to compliance review.

K-3 may update these Terms of Service from time to time.
The version posted on the website at the time of your use will apply to that use. For purchases, the Terms of Sale accepted at the time of order will apply to that order.
18. Severability
If any provision of these Terms of Service is found invalid, unlawful or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by applicable law.

Any failure by K-3 to enforce a right or provision of these Terms of Service does not constitute a waiver of that right or provision.
20. Governing law and disputes
These Terms of Service are governed by the laws of the State of Florida, United States, without regard to conflict of law principles, except where mandatory consumer protection laws provide otherwise.
Where permitted by applicable law, any dispute relating to the website or these Terms of Service shall be submitted to the competent courts located in Miami-Dade County, Florida, United States.
Nothing in this section limits any mandatory rights that a consumer may have under the laws of the country or state of residence.
